1.1. These Terms apply to all photography and videography services provided by the Photographer.
1.2. By booking a session, the Client confirms they have read and accept these Terms.
2.1. To reserve a date, the Client pays a CHF 100 booking fee ("booking fee").
2.2. The date and time are confirmed only after the booking fee is received.
3.1. The CHF 100 booking fee is non-refundable if the Client cancels.
3.2. The Client may reschedule once, provided that:
3.3. If no mutually suitable date can be agreed within 1 month (no overlap in availability or schedule conflict), the session is treated as cancelled under 3.1.
3.4. Requests made less than 24 hours before the session are treated as a cancellation under 3.1, unless otherwise agreed in writing.
4.1. Force majeure includes sudden illness, accident, emergencies, and sudden severe weather that was not forecast.
4.2. In case of force majeure, the session will be rescheduled to a new date.
4.3. Force majeure rescheduling does not count as the one reschedule in 3.2.
4.4. In force majeure cases, the booking fee is not refunded; rescheduling applies.
5.1. If severe weather occurs and the shoot has just started, and no reasonable compromise or Plan B can be found, the session may be rescheduled (Section 4).
5.2. If approximately half of the booked time has already passed, the parties switch to Plan B (alternative location or format) without rescheduling.
5.3. For sessions outside Zurich: if the session is rescheduled, the Client covers the Photographer's actual travel costs already incurred for that date (for example, non-refundable tickets).
6.1. If the Photographer cannot deliver due to serious force majeure, the Photographer will either refund all paid amounts or offer a reschedule.
6.2. For non-movable events (studio booking, restaurant, or event), as soon as it becomes clear the Photographer cannot attend, the Photographer will notify the Client as early as possible (where feasible, no later than 24 hours) and help find a replacement photographer.
6.3. The replacement photographer works under their own pricing, and the CHF 100 booking fee may be transferred to them as part of the payment.
7.1. The remaining balance is due immediately after the session, unless otherwise agreed in writing.
7.2. Final delivery may be withheld until full payment is received.
8.1. The session takes place within the booked time slot. If the Client arrives late, the session is not extended and the delivered content (photo or video) may be significantly reduced compared to the package description.
8.2. If the Client does not respond and does not arrive within 30 minutes of the start time, it is considered a no-show; the booking fee is not refunded.
9.1. Studio rental, entrance tickets, parking, permits, and other extra costs are paid by the Client, unless agreed otherwise in writing.
9.2. Sessions outside Zurich may include travel costs as per the price list or agreement.
10.1. Standard photo delivery is JPG.
10.2. RAW files can be provided upon request at no extra cost. RAW files are unedited and may look different from the portfolio style; special software may be required.
11.1. Delivery is provided via an online gallery. Gallery access: 30 days.
11.2. Files are stored by the Photographer for up to 6 months, after which they may be deleted.
11.3. Re-delivery after gallery expiry or after a long time is subject to file availability and may require additional time or an administrative fee.
12.1. "All JPG photos (100+)" are delivered within 24 hours after the session (as per the package).
12.2. Final edited photos (color correction or retouch) are delivered within up to 14 days after the Client's selection, or after confirmation that the Photographer will select.
12.3. If selection is received before 16:00 (Zurich time), the 14-day period starts that day; if received after 16:00, it starts the next day.
13.1. If the Client selects images for editing, selection must be provided within 3 weeks.
13.2. If no selection is received in time, the Photographer may select the images to avoid delays.
13.3. Once editing starts, selections cannot be changed. Additional edited images are charged according to the price list.
14.1. The Client acknowledges the Photographer's portfolio and classic style.
14.2. Editing preferences (color mood, retouch notes) must be communicated before editing begins, during selection.
14.3. A minor revision is possible only if agreed in advance (during booking or the shoot) and for one photo only.
14.4. A full re-edit (new color correction based on the Client's preferences plus retouch from scratch) is available for 70% of the package price.
15.1. If the package includes video, it is delivered in the Photographer's style.
15.2. One revision is included, and it must be clearly specified (for example, trimming or changing the order of clips).
15.3. Music: if agreed with the Client, the agreed track is used; if chosen by the Photographer as a creative decision, music is not changed.
16.1. The Client may edit the delivered materials for personal use, but the Photographer is not responsible for results after third-party edits (filters, color changes, retouch by others).
16.2. Third-party edited versions should not be presented as the Photographer's final work.
17.1. Copyright remains with the Photographer.
17.2. Individual or family sessions: personal use only; commercial use requires separate written consent.
17.3. Business or commercial sessions: commercial use for the Client's own business purposes is permitted unless otherwise agreed in writing.
18.1. Paid sessions: publication of photos, videos, or behind-the-scenes by the Photographer is allowed only with the Client's explicit consent (see consent section).
18.2. TFP or free sessions: the Client or model agrees that the Photographer may use the content for portfolio, social media, website, and advertising.
19.1. If minors are involved, publication consent (if given) must be signed by a parent or legal guardian.
20.1. In case of data loss due to technical reasons, the Photographer offers a free reshoot.
20.2. Documented hair and/or makeup costs for the specific session will be reimbursed, and total liability is limited to the order amount.
21.1. If a participant is intoxicated, aggressive, or unsafe, the Photographer may end the session.
21.2. In such cases, the booking fee is not refunded.
22.1. Personal data is processed confidentially and used only to organize and deliver the service (including online gallery delivery).
22.2. Data is not shared with third parties except with service providers necessary to deliver the service (storage and delivery platforms, etc.).
23.1. The Photographer is not VAT-registered; prices are stated without VAT unless stated otherwise.
24.1. Swiss law applies.
24.2. Venue is Zurich, Switzerland.
25.1. If any clause is invalid, the remaining clauses remain effective.
